By accessing or using this site, you acknowledge and agree to the disclaimers, terms, and conditions set forth below. Please read the following carefully: Not all products or services discussed or referenced herein are available to all persons or in all geographic locations. We reserve the right to limit or alter, at our sole discretion and without limitation, all aspects of service(s) rendered, to include but not to be limited to, the provision and quantity of any product or service to any person or geographic area. Any offer for any product or service made in or through this site is void where prohibited.

Service Providers

We have Service Providers nationwide and we are continuously adding locations and services offered. In the event that we choose to alter or withdraw Service Providers, comparable alternatives will be offered.

Information & Promotional Material

We strive to keep all information regarding the Photo Booth Rental as accurate and up-to-date as possible. However, precise details of each Event may change from time to time and from Provider to Provider. The Events and information described and provided within promotional materials and websites are subject to change without notice. The pictures used to display Events, in all promotional material and websites, are for illustrative purposes only and may not accurately reflect the details of an individual Event. The duration of each Event is an approximation under ideal circumstances. Details regarding the number of participants, wait time, facilities, faculty, and other location specific Events solely depend on the operations, policies, and procedures of each Service Provider, all of which are outside of our control. We will provide itineraries and other relevant information as a guide whenever possible.

Event Requirements

It is the responsibility of the participant to comply with all necessary requirements of the Event as set by us or any enacted Service Provider. Descriptions will, as accurately as possible, explain the limitations or requirements relating to each Event. Participants may be liable for costs from cancellations due to such restrictions. Full details of all restrictions for each Event may be obtained by contacting our Customer Service department.

Availability

Events should be booked a minimum of 7 days in advance and further for weekends or holiday periods. Selective Events and Service Providers may be seasonal, and certain popular times such as holidays, that may become unavailable earlier than others. To increase the likelihood that your preferred date and time will be available, it is suggested that you call at least a two (2) months in advance if you would like to secure an event for a special occasion or holiday. While we strive to meet your needs, we cannot guarantee that we will be able to provide a Photo Booth on a chosen day. Participants will receive a receipt by email of their Event. We will confirm each booking with the Participant.

We reserve the right to substitute certain elements of the Event, should those elements become unavailable due to circumstances beyond our control. We reserve the right to cancel an Event based on the availability of our Service Provider(s). In this event, a Customer Service Representative will attempt to contact you, and, only in the context of Service Provider availability, your activity will be rescheduled at a time of your choosing.

Refunds

Refunds are available only in the event that the purchased activity can no longer be offered in any form. If approved, all refunds will be issued to the purchaser of the reservation or gift certificate. We may also be required to uphold pre-existing vendor policies, which may include, but are not limited to, additional penalties or forfeitures. Reservations cancelled prior to 72 hours from the corresponding date and time of service may be rescheduled for 2 years from the date of original purchase.

Events may be cancelled by the service provider for various reasons which may include, but are not limited to, inclement weather, equipment maintenance, emergencies, or other unforeseen circumstances. In the event of inclement weather, most vendors will work with the Purchaser if they opt to reschedule the event. Regardless of individual vendor policies, we will attempt to find a service provider able to fulfill your purchase. To request a refund, contact our customer service department containing the purchaser name, address, event date, telephone number and all information pertaining to the request. Expect a response within (10) business days.

Agents are available to accept your phone calls weekdays at our Corporate Headquarters. Hours of operation may vary seasonally, but agents are generally available during times convenient for customers located in regions stretching from the East Coast to the West Coast.

Cancellations

If you are unable to make your have your Event for any reason, you must contact us prior to seven (7) days before your Event. You must provide the certificate or reservation number and any relevant purchaser information along with the date and time of the appointment. This will allow you to transfer your credit to another day pending availability. A transfer of date can only be done one time per reservation. A refund cannot be offered for a cancellation.

Your Right To Privacy

If you wish to purchase products or services described in this site, you may be asked to supply certain information, including credit card or other payment information. By providing such information, you represent and warrant that it is accurate, complete, and current. By making any such purchase, you agree to pay all charges (including shipping and handling charges) incurred by users of your credit card or other payment mechanism at the prices in effect when such charges are incurred. You are responsible for paying any taxes applicable to such a purchase. Data about the activity of visitors to this site is automatically provided to us. We may use or disclose information about your demographics and use of the site in any manner that does not reveal your identity. Email addresses, postal addresses, or telephone numbers and other personally identifying data about you is known to us only when voluntarily submitted or posted to this site. We may use such personally identifying information, as provided by you, to communicate with you regarding Events. We may also use this information to communicate advance notice of events and new products and services. We reserve the right to refuse any order for any reason. Orders may be delayed or canceled if we are not given completely accurate information and/or are unable to contact the person who has placed the order or the primary cardholder.

Other Terms & Conditions

We are independently owned and operated. Each Service Provider is individually responsible for their health and safety standards and operating practices. We make no guarantees of the consistency, efficacy, or safety of individual Service Providers. We accept no responsibility and shall not be liable for any loss, injury, claim, cost, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability or otherwise arising out of, or in any way connected with: (a) the use and redemption of this certificate or (b) the performance or nonperformance by any Service Providers ,even if all parties have been advised of the possibility of damages. We shall under no circumstances be liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces or causes beyond our reasonable control.

By booking with our service, the participant accepts all Terms and Conditions stated at the time of service and releases us from any and all liability for any loss, injury, claim, cost or damage directly or indirectly connected with the chosen Event. If any provision of this Agreement is found to be invalid or unenforceable in any respect, the validity and enforceability of the remaining provisions shall remain unaffected. All clerical errors are subject to correction. The failure for us to enforce, at any time, any of the provisions of the Agreement shall not be construed to be a waiver of any provisions or the right of us to enforce such provisions in the future. Purchaser may not assign any rights under this Agreement without the written consent. Purchaser shall have no right to set off amounts due with respect to one transaction for claims under any other transaction with us.

Any disputes arising under this Agreement shall be resolved, if not sooner settled, by a state or federal court of competent jurisdiction located in Georgia, U.S.A., and the Purchaser hereby irrevocably submits to the exclusive jurisdiction of such courts. These Terms and Conditions are subject to change without notice.

DEFINITIONS

Purchaser The person who completes the financial transaction with us. An electronic receipt will be provided to the purchaser at the time of the transaction. Service Provider Any corporation, individual, or group of individuals, designated by us engaged in the provision of Events or related materials.
